Who We Are, and Acceptance of These Terms

Seekquel is operated by Stratos Digital Marketing, a development agency registered in Tunisia, reachable at [email protected]. By creating an account or otherwise using Seekquel ("the Service"), you agree to these Terms of Service. If you do not agree to them, do not use the Service. Our Privacy Policy explains how we handle your data and forms part of this agreement.

Who May Use Seekquel

You must be at least 13 years old to create an account. If the law where you live sets a higher age for consenting to online services on your own, which is 16 in some EU countries, you must meet that age instead. You must not use the Service if we have previously terminated your account.

Account Responsibilities

You are responsible for keeping your account credentials secure. You must give accurate information when creating an account. You are responsible for all activity under your account. Tell us immediately if you suspect unauthorized access.

Acceptable Use

You agree not to: submit false or misleading book information, ratings or reviews; harass, abuse or threaten other readers; post content that is illegal, hateful, or sexual material involving minors; attempt to reach other readers' accounts or private data; use automated tools to scrape or overload the Service; manipulate ratings, suggestions or the contributor leaderboard; upload content you have no right to share; or upload malicious content or attempt to compromise the Service's security.

Your Content

You keep ownership of the content you create: reviews, notes, captured passages, photos, shelf and list descriptions, messages, feedback posts and posts. By posting content you grant Seekquel a non-exclusive, worldwide, royalty-free licence to store, display and distribute it within the Service, and to display publicly-shared content on public pages, in link previews and in share cards. That licence runs for as long as the content is on the Service and ends when you delete it, except for copies already held in backups until those expire. You confirm you have the right to post what you post. You can delete your content at any time.

Catalog Contributions

The book catalog is shared by everyone who uses Seekquel. When you correct a book, add an edition or a character, write a FAQ answer, or submit a book to the catalog, that contribution becomes part of the catalog and is licensed to us and to other readers for that purpose, irrevocably, because the catalog cannot be unpicked one reader at a time. Contributions stay in the catalog after you delete your account, detached from your name, because other readers' pages are built on them. Your own private books, notes, reviews and library are not catalog contributions and are not covered by this.

Moderation, Reporting and Appeals

You can report a post, review, comment, message, passage, photo or catalog entry from the app, and you can follow what happens to every report you file. You can also report content you believe is illegal, in the app or by email, telling us where it is and why; we will confirm we have it and decide without undue delay. We may hide, remove, restrict or refuse content that breaks these terms or the law, we may reverse a catalog contribution that turns out to be wrong, and we may suspend or restrict an account that repeatedly breaks these rules. If we hide or remove your content or restrict your account and you think we got it wrong, contact us from the Support page or at [email protected] within six months and a person will review the decision. Nothing here removes your right to go to a court or to an out-of-court dispute body.

Intellectual Property

Book information is assembled from Open Library, ISBNdb, Google Books, The New York Times and other public sources, each subject to its own terms. Cover images belong to their publishers and rights holders and are shown to identify the book. The Seekquel application, its design and its proprietary features are protected by copyright. You may not copy, modify or distribute the Service's code or design without permission, except where a licence we publish says otherwise. If you believe a source has been used wrongly, tell us and we will correct or remove it.

Copyright Complaints

If you believe something on Seekquel infringes your copyright, contact us at [email protected] with enough detail to identify the work and where it appears, your contact details, and a statement that you are the rights holder or authorised to act for them. We will review it and remove anything infringing. We may pass your notice to the person who posted the content, and we may terminate the account of anyone who infringes repeatedly.

Automatically Generated Content

Some book information, including descriptions, genres, moods, characters and FAQ answers, is drafted automatically from public sources and may be wrong or incomplete. It is marked as correctable and any reader can propose a fix. Recommendations, statistics and reading estimates are calculated from the data available and are not guarantees.

Affiliate Links

Some links to buy or borrow a book are affiliate links, and we may earn a small commission when you buy through one. This costs you nothing extra, and it never affects which books we show you, how they are ranked, or what a rating says. Nobody pays for placement in the catalog, in search, or in recommendations.

Subscriptions and Payments

Seekquel Pro is sold as a monthly or yearly subscription, or as a one-time lifetime purchase, and is billed entirely through the Apple App Store or the Google Play Store. The price shown in the app before you buy is the price that applies in your country and currency. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends, and you cancel from your Apple or Google account settings rather than from Seekquel. Billing, renewals, free trials, price changes and cancellations are governed by the store's own policies. Seekquel does not process payments, never sees your card details, and cannot issue refunds; all refund requests are handled by Apple or Google under their refund policies. If you are a consumer in the EU or the UK you normally have 14 days to withdraw from a purchase of digital content, a right you may lose once delivery begins with your agreement, and which the store handles on our behalf. Free features remain available without a subscription, and if a subscription lapses nothing is deleted: Pro features pause and return when you resubscribe.

Apps Obtained Through Apple

If you got the Seekquel app from the Apple App Store, this agreement is between you and us, not with Apple, and Apple is not responsible for the app or its content. We alone are responsible for support, maintenance and any warranty; if the app fails to conform to a warranty, you may tell Apple and Apple will refund the purchase price, and Apple has no other warranty obligation. We are responsible for handling any claim that the app or your use of it infringes intellectual property or breaches consumer law. You confirm that you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Third-Party Devices and Integrations

Seekquel can sync with a reading device or a desktop library through add-ons you install yourself: our KOReader plugin, which sends your place in a book, the time you spent reading, your highlights and whether you finished; and our Calibre plugin, which carries reading status (want to read, reading, read), ratings, reviews and reading dates in both directions, but not custom shelves. Both are open source, published under the licence stated in each add-on, and both send only what you have set them to send. The reader software they run inside, and any other add-on you install, is supplied by third parties we do not control. You are responsible for what you install on your own device, and for having the right to the files you sync.

Disclaimers

The Service is provided "as is" without warranties of any kind, so far as the law allows. Book information, automated analysis and recommendations may contain inaccuracies. We do not guarantee the availability, accuracy or completeness of any book data, and we do not guarantee uninterrupted service.

Limitation of Liability

To the maximum extent permitted by law, Seekquel shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the Service, including but not limited to loss of data or service interruptions. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law. If you are a consumer, your statutory rights are unaffected by this section.

Your Responsibility to Us

If someone brings a claim against us because of content you posted, or because you broke these terms or the law, you agree to cover the reasonable costs and damages that result, so far as they are attributable to what you did. This does not apply where the law does not allow it, and it does not apply to ordinary use of the Service.

Termination

We may suspend or terminate your account if you break these terms, and we will tell you why unless the law stops us. You may delete your account at any time. On termination your right to use the Service ends, and your data is handled as described in our Privacy Policy. The sections on catalog contributions, intellectual property, disclaimers, liability and governing law survive termination.

Governing Law and Disputes

These Terms of Service are governed by the laws of Tunisia, and any dispute arising from them will be brought before the competent courts of Tunisia. This does not affect any mandatory consumer protection rights you hold under the law of the country where you live, nor your right to bring proceedings in your own country's courts where that law gives it to you.

General

These terms, together with the Privacy Policy, are the whole agreement between us about the Service. If any part of them is found unenforceable, the rest stays in force. Our not enforcing a term is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours if the Service changes hands, and we will tell you if that happens.

Changes to These Terms

We may modify these Terms of Service. Material changes will be communicated in the app, with reasonable notice before they take effect where the law requires it. Continuing to use Seekquel after a change means you accept the updated terms.
